Chow Ting v Teng Yu Yan Anne [2019] HKCFI 2135

Chow J gave Judgment on 2 September 2019 to allow the Election Petition because the returning officer failed to give Agnes Chow a reasonable opportunity to respond to the materials intended to be relied upon by the Returning Officer for the decision that the nomination is invalid.  Chow J further held that such an irregularity is material and refused to dismiss the Election Petition on the ground that giving Agnes Chow an opportunity to present her case would have made no difference to the outcome.
