[CPD Talk] Old Age and Beyond: Powers of Attorney, Mental Health Ordinance Part II and Beddoe Applications
Age brings with it specific legal issues and challenges. On Friday 4 October 2024, speakers from Denis Chang’s Chambers, Jeremy S.K. Chan, Valerie Tang and Jason Ko, will examine issues which arise from three specific areas of the law namely the use of powers of attorney, mental capacity as well as disputes after death. Speakers will share their observations on these areas and suggest best practices when facing such problems as well as examine what might be lessons for the future.

Jeremy Chan

Jeremy Chan has been featured in Doyle’s “Leading Family & Divorce Law Barristers” Guide for consecutive years, with the directory again featuring him as the only ‘Market Leader’ Junior Counsel in Hong Kong.
Jeremy is a leading Junior Counsel specialising in all areas of Family Law with a particular focus on the areas of Matrimonial Finance, Private Clients, Inheritance, Probate and Trusts.
Called to the Bar in 2000, Jeremy has forged a career as a “go-to Junior” for Family matters and is noted for his “tough and very thorough” advocacy, he is “one of the top three Juniors in the field” and is considered to be “one of the most prominent Counsel here” in Hong Kong.
Jeremy is particularly noted for being “very numerate” and “with a good commercial sense” which “equip him particularly well in tackling high-value or financially complex cases”. Jeremy’s flourishing career has seen him be involved in the largest family disputes in Hong Kong, and he often represents clients within the Court of Appeal, often not associated with family proceedings.
Relevant to the issues discussed in this article, Jeremy represented the husband respondent in ML v YK (2010) 13 HKCFAR 796, a case involving a PRC divorce and in which the Court of Final Appeal in obiter dicta commented on the need for introduction of legislation enabling Hong Kong to provide, in appropriate cases, for ancillary relief in respect of marriages dissolved outside Hong Kong, ultimately leading to the enactment of Part IIA of the ) Matrimonial Proceedings and Property Ordinance (Cap. 192).

Valerie Tang

Valerie was called to the Bar in 2019. Since joining Chambers, Valerie has established a broad civil practice with an emphasis on commercial and matrimonial matters. Valerie has been a Member of the Chartered Institute of Arbitrators since 2020.
In A v B (HCMP 1625/2021), Valerie (with Mr Jose Remedios) acted for the successful Plaintiff in obtaining a Mareva injunction and Anton Piller Order under Section 21M in aid of foreign proceedings concerning HK$708 million worth of cryptocurrency.
More recently, Valerie obtained a return and non-removal order for children abducted from Hong Kong to a non-Hague Convention contracting state in MF v LJL (FCMC 655/2023).
In addition to her commercial and family practice, Valerie also regularly acts as sole advocate in land, probate, PI and employment matters. She is similarly well-versed in mental health related applications, such as Part II inquiries.
Prior to obtaining her law degree from the Chinese University of Hong Kong, Valerie read International Relations at the London School of Economics and Political Science. During her legal studies, she also served at the Legislative Council of Hong Kong from 2015 to 2018 where she was involved in, inter alia, bill drafting and policy research.

Jason Ko

Jason is a Charles Ching Scholar. He has been recognised by Legal 500 Asia-Pacific 2024 as a Rising Star in both “Commercial Disputes” and “Regulatory, Investigations and Crime” categories.
Since joining Chambers in 2019, Jason has acted in a wide range of civil and criminal matters, including successfully seeking injunctions restraining acts of harassment and defamation. He also acted for the defendant in the first Hong Kong trial of disclosing personal data without data subject’s consent, contrary to section 64 of the Personal Data (Privacy) Ordinance (Cap 486): HKSAR v Ip Anthony Chun Hin (WKCC 1638/2022) (led by Philip Dykes SC).
Recently, Jason acted for the successful Plaintiffs in civil contempt proceedings where the Defendant has acted in breach of an anti-harassment injunction order: Chuang’s China Investments Limited v Zhou Changchun [2023] HKCFI 2427 (with Mr Richard Yip).
