CPD Talk at Ince & Co — Updates on recent Court of Final Appeal cases

On 8 December 2025, Anson Wong Yu Yat delivered a CPD seminar at Ince & Co Hong Kong on two recent Court of Final Appeal cases in which Anson is involved.   

The first case, Chui Marjorie Che Ying v Appeal Tribunal (Buildings) (FAMV 104/2025), concerns the proper interpretation of section 28(3) of the Buildings Ordinance, Cap 123, which empowers the Building Authority to issue repair orders. The Appeal Committee’s Determination also touches on quasi-easements in the context of a multi-storey building. Anson argued the case on behalf of the Applicants before the Appeal Committee.

The second case, To Sze On v Yim Tin Fook (FAMV 142/2025), concerns a land dispute which raised three questions of law involving: (1) the principle in Milmo v Carreras [1946] KB 306, (2) the effect of the New Territories Leases (Extension) Ordinance, Cap 150, and (3) the effect of the Land Registration Ordinance, Cap 128 on competing claims to title. Anson acted for the successful Plaintiffs in the Court of Appeal: [2025] HKCA 675, [2025] 4 HKLRD 193. The 2nd Defendant is seeking leave to appeal to the Court of Final Appeal, which application will be heard by the Appeal Committee on 12 December 2025.

Anson has developed a broad civil practice with a growing practice in insolvency and bankruptcy matters in recent years. He is experienced in handling complex questions of law, including those of great general or public importance which reached the Court of Final Appeal. For example, he has recently appeared in (among others) three civil appeals before the Court of Final Appeal dealing with important questions concerning insolvency matters, land law and equity, service out of jurisdiction and statutory interpretation.
