Sharing session by Professor Richard Ekins KC (Hon) at DCC – Judging proportionality: Rights adjudication and the rule of law
Join our sharing session with Professor Richard Ekins KC (Hon) on the topic of “Judging proportionality: Rights adjudication and the rule of law” at Denis Chang’s Chambers on 11 September. Denis Chang SC, the head of our Chambers, will serve as the moderator.
The doctrine of proportionality has a central place in modern rights adjudication, yet its nature is often contested and misunderstood. This session will reflect on the nature of proportionality and will consider the extent to which the doctrine risks implicating judges in a form of reasoning that is difficult to reconcile with the limits of judicial competence and responsibility. These risks will be considered and illustrated by reference to European human rights law and its partial incorporation into British law.
About the speaker
Richard Ekins KC is Professor of Law and Constitutional Government in the University of Oxford. He leads Policy Exchange’s Judicial Power Project and jointly directs the Programme for the Foundations of Law and Constitutional Government in the University of Oxford. He was made King’s Counsel Honoris Causa in 2022. He is Des Voeux Chambers Oxford-HKU Visiting Fellow and Cheng Yu Tung Visiting Professor at the Faculty of Law of the University of Hong Kong.
About the moderator
Denis Chang SC, KC is a Senior Counsel in private practice, Head of Denis Chang’s Chambers, Honorary Professor at HKU’s Law Faculty, and Council Chair of St Francis University. Appointed Queen’s Counsel in 1981, he has served as Chairman of the Hong Kong Bar Association, member of the Executive Council, and Executive Committee Member of the former Basic Law Consultative Committee.
